Terms of Use

1. Agreement

By accessing or using PropHaven (the “Service”), you agree to these Terms of Use. If you do not agree, do not use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

2. The Service

PropHaven provides property management software for landlords, property managers, agencies, and renters, including tools for listings, occupancy, tenant invitations, document collection, and related workflows. Features may change over time. We may add, modify, or discontinue functionality with reasonable notice where practicable.

3. Accounts and eligibility

You must provide accurate registration information and keep your account credentials secure. You are responsible for activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account unless permitted by a parent or guardian with appropriate authority.

4. Acceptable use

You agree not to:

• use the Service unlawfully or in violation of applicable regulations;
• upload, store, or transmit content that infringes rights, is fraudulent, harassing, or harmful;
• attempt to gain unauthorised access to the Service, other accounts, or related systems;
• interfere with or disrupt the integrity or performance of the Service;
• reverse engineer or copy the Service except where permitted by law.

5. Customer content

You retain ownership of content you submit to the Service, including property details, tenant information, and uploaded documents. You grant PropHaven a limited licence to host, process, and display that content solely to provide and improve the Service. You are responsible for obtaining any consents required to collect and process personal data of tenants, staff, and other individuals through the Service.

6. Subscriptions and fees

Paid plans, pricing, and billing terms are described on our website or in an order form. Fees are quoted in Kenyan shillings unless stated otherwise. Unless required by law or expressly agreed in writing, fees are non-refundable. Failure to pay may result in suspension or termination of access.

7. Third-party services

The Service may integrate with third-party providers such as authentication, email delivery, or hosting services. Your use of those services may be subject to their separate terms and policies. PropHaven is not responsible for third-party services outside our reasonable control.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, PropHaven disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or suitable for every legal or regulatory requirement in your jurisdiction.

9. Limitation of liability

To the fullest extent permitted by law, PropHaven and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the Service. Our aggregate liability for claims relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim, or KSh 10,000 if no fees were paid.

10. Suspension and termination

We may suspend or terminate access if you breach these terms, if required by law, or to protect the Service and its users. You may stop using the Service at any time. Provisions that by their nature should survive termination will continue to apply.

11. Governing law

These terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles. Courts in Nairobi, Kenya shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.

12. Changes and contact

We may update these terms from time to time. Material changes will be posted on https://www.prophaven.co.ke with an updated date. Continued use after changes take effect constitutes acceptance. Questions may be sent to hello@prophaven.co.ke.
